 2. Have the Defendants used your name, a minor child or you are not a member of the Western Cherokee on a petition which you did not authorize the use of your name to be used this way?

We have received a list of what was stated as more than 100 signatures to remove Chief Summers, Vice Chief Watson, Council persons Jeff Cover, Ron Quick and Barbara Emmons. This list was never made known until after the August 29, 2006 list when Tim Spencer send a list of some 61 names including those that disrupted our meeting with threats, this was 10 days after the August 19th meeting. Unless our count is wrong there are only 98 names and many are questionable to membership or legal right to have their names on the list.

 

Defendants and/or associates are now saying the Plaintiffs added names to their petition, click here to see the list of names as it was handed over to the court and is a copy from the court.

These people were at the August 19th meeting which now claim to be in some kind of official position and have been part of the disruption in some way: Shawna Ellis (Removed from Enrollment and Wife of James Ellis, defendant) James (Jim) Gowan (Not a Member, shoved spear in Chief Summers face, assaulted Vice Chief Watson) Shawn Haynes (Son-in-law of Bea Foster, has not gone public in any way known) Francis Rutherford (Sister of defendant Geneva Merritt) Harold Sischo (Son of Bea Foster) Eric Smith (Resigned as Editor of the Red Path some 3 years ago and close friend of Tim and Laurie Spencer) Janet Smith (Resigned from Council some 3 years ago partially due to Chief Summers not placing James Ellis on Recall) Laurie Spencer (Resigned as Treasurer/Secretary some 2 years ago, took her families records and attempted to take westerncherokee.com from us saying it belonged to her and more) Timothy Spencer (Walked away from Council some 2 years ago, returned his card, broke arrow and threw it at Vice Chief Watson, threatened riot and more) Neekisha Spencer (Daughter of Tim and Laurie Spencer and was listed as an official, has not gone public in any way known)   We find it interesting how all these names above fit together in so many ways. A name which is not on the list but claims to be in a leadership position is Larnce R. Bailey which is related to Susie Baliley and/or James Ellis in some way and stated he was "security at tribal complex" which he seemed to be living at our Complex at one time.

3. Why the petition that is circulating is not within our Constitution.

ARTICLE VII
REFERENDUM

 

Section 1.  Upon receipt of a valid petition signed by 5% of the qualified voters of the Western Cherokee Nation protesting any enactment of the Tribal Council, the Election Board shall call and hold a special referendum of the tribe to vote on whether the action of the Tribal Council shall be vetoed or upheld.  No such petition may be filed later than ninety (90) days following the questioned enactment of the Tribal Council.  The majority of the votes cast in such a referendum shall be conclusive and binding on the Tribal Council for a period of twelve (12) months.  The expense of such a referendum shall be borne by the tribe.  Any petition for referendum must state clearly the nature of the petition and contain verifiable contact information of all petitioners.

 

The petition turned over to the court was of typed names and not one signature, nothing legal can be done without a signature and a way to verify their name.

 

People have been coming forward saying they had no knowledge of their names being used, some who are not even members and minor children.

 

The petition within our Constitution is "not" for removal as one can clearly see. It was designed for the protesting an enactment of the Tribal Council.

 

What enactment of Tribal Council are the signers protesting if they truly have signed it? We believe most signers were given a story without any evidence to back it up, as of today no one has seen any evidence to any charge.

 

We do have a method for recall but it takes people with evidence, not a petition without true evidence. Would want to be one of the five people being removed without evidence and on the word of people who are known not to tell the truth?
