It has been a year and the people who took over still have not produced on piece of evidence of wrongdoing. This meeting of 8/19/06 and the empting of our offices of 8/27/06 is what brought us into court.

 

James Ellis et al have talked about how we choose what we published from the video. They made a video that same day but why have they NOT presented it for you to see their allegations?

 

There was nothing on the agenda mentioning any charges filed against those who are not the Plaintiffs which now have two court orders supporting them.

 

If Elders Carlino and Dee were not part of the take over, they assisted by not listening to the concerns of the past when James Ellis was in question. They were very seldom around for activities but never acknowledged the concerns of Chief Summers, Vice Chief Watson and Council when it was brought to them about James Ellis.

33:45 Laurie Spencer reads a letter from Elder Bea Foster. NOTE, She says nothing of resignation but does speak about issues she has not been around to know about, therefore she is speaking on hearsay. Elder Bea's letter states she and Elder Elmo will not resign, but Elder Elmo Foster had is deceased some time back.
Neither Carlo Carlino or Diane Dee called Chief Summers, Vice Chief Watson, Council persons Jeff Cover, Ron Quick or Barb Emmons on any of these issues below. Both of these two are speaking from hearsay.
35:30 Diane Dee, (companion of Carlo Carlino) speaks on her not being informed about things until after they are done NOTE, This is not within our Constitution, WC Constitution does not cover informing Elders, this has always been done at the next meeting and Council has always passed things between meeting which James Ellis was Council Speaker. She uses hearsay as a way of presenting it as evidence. She brings up spreading our dirty laundry over the internet which in reality James Ellis and Gail McElfresh's postings that made it where we had to respond.
39:30 Carlo Carlino, companion of Diane Dee speaks on allegations which he admits he did not know the truth on which make it nothing more than hearsay. The confidentiality agreements that he wanted everyone to sign a few years ago he speaks of were signed by everyone but James Ellis which Mr. Ellis refused to sign. NOTE, Council discovered Carlo Carlino did not have a file on record.

Anyone who has ever been to any kind of meeting or has been part of a meeting knows you deal with each issue separately. James Ellis et al takes the entire meeting and confuses everything to were it is impossible to keep up with the allegations which to this day, a year later they have produced no evidence of wrongdoing.

05:00 Concerns from the Executive Office, this was place on the agenda by Councilwoman Barb Emmons for Vice Chief Watson to discuss the problems in enrollment and the office. James Ellis uses this to take over the meeting when later he admits it was Barb Emmons (See pt.2,  34:10). This being placed on the agenda by Ms. Emmons, Mr. Ellis does not address Ms. Emmons and from this point on it becomes his meeting, ignoring everything. Mr. Ellis and his group flat out ignore everything our  Chief, Vice Chief and Council say. James Ellis calls for a to 10 minute recess while he puts together his plan
17:00 Vernon Strickland (member) mentions that help is needed in the kitchen.
19:00 Deana Hennington speaks on how meeting are to be help, she had not been to a meeting in some five years.
22:30 James Ellis takes Vice Chief Watson's agenda issue, placed on agenda by Barb Emmons and uses it as his agenda item.
23:45 James Ellis talks about Special Meeting that Council declined having. Mentioning the files which Mr. Ellis demande and had no right to, he brings up the argument he had with Vice Chief. Lets the people know the offices were locked. NOTE, he  does not mention that it was passed by majority vote due to James Ellis refusing to abide by his suspension.
26:30 James Ellis speaks on contract between (Tim Spencer, James Ellis wrote) the Tribe (NOTE, their filing as a Unincorporated Association which is not a tribe and has serious legal risks) and Non-Profit. NOTE, The Defendants have ignored the Federal Court Order stating: The defendants, the Western Cherokee, represented by Roy Meeks, claims to support a tribal entity that was incorporated as a non-profit corporation in Missouri, with Council members consisting of Jerry Summers, James Ellis, Tim Sanders, Kelly Bernal, John Watson, Curtis Sumner, Tim Spencer, and Janet Smith. James Ellis has a point to his argument but fails to mention he was Council Speaker and never mentioned it until he needed it to benefit him and that Legally the a Federal Court had already made the desicion that we are a Non-Profit Corp.

28:50 James Ellis claims the resolution order members not to go on Western Cherokee property, NOTE, he fails to tell the people it was James Ellis and Gail McElfresh were the only ones not allowed on property unless it was an event or approved by the Chief or Council, this was to protect Western Cherokee properties and due to Mr. Ellis ignoring all actions of Council He goes on to claim every Resolution Council passed was not valid.
29:40 James Ellis claims he was not given due process NOTE, his due process was to take place the day of this meeting and his charges against James Ellis, other charges and Gail McElfresh, other charges and was not given the charges filed which is flat out, not true. Council has evidence to the contrary.
33:30 James Ellis goes on with some of his concerns of the Power of Attorney (POA). Councilman Jeff Cover says this should be brought out in the hearing. NOTE, it is a matter of record Council did not see a problem with the POA after asking about it. The POA was VERY limited and had to have Chief Summers approval each and every time it was used. James Ellis never talked with Chief Summers on this issue.
34:10 James Ellis brings up the Concerns from the Executive Office and says it was place on the agenda by Barb Emmons. NOTE, James Ellis never asked Ms. Emmons or give her a chance to speak on her issue. Completely Out Of Order on James Ellis's part and ignores Jeff Cover.
34:25 Vice Chief Watson lets James Ellis know that he had Barb Emmons place it on the agenda. Tim Spencer admits the Contract was written by him and James Ellis.
35:50 James Ellis ignores Vice Chief and still does not recognizeas him as having the flood on the agenda item. James Ellis speaks on Chief Summers Executive Decision to protect the WC Constitution.

44:05 James Ellis talks about agenda of June meeting and why he did not put the issue of the Power of Attorney on the agenda NOTE, James Ellis made up the agenda and did not have it on the April, June or August meeting agendas. Council had discussed this issue and did not see it as an issue, James Ellis wanted to make it an issue. There are serious legal issues for a person who uses a POA in a way that is not authorized, James Ellis had ignored this issue when Council tried explaining it to him. Second, to protect the person holding a POA it is not something that is made public, very few people ever know of when someone has another's POA.
45:20 Vernon Strickland (member) brings up how he would like the connectivity of Mr. Ellis's concerns. NOTE, Mr. Ellis does not say on any issue for very long and calls everyone who disagrees with him as not being honest and not allowing time for questions on each issue.

James Ellis goes back to phone conversation and claims it all goes together and he did call Chief Summers back.
45:50 James Ellis goes on with allegations which are based on the locking down of the offices NOTE, offices were locked due to James Ellis refusing to abide by Council directives and allegations made, Chief and Council did this to protect WC property.
49:55 James Ellis talks about Chief Summers Order to put the  records of Officials to put them in safe keeping so the could not be tampered with. NOTE, Chief Summers knew we had some problems and signed the Executive Decision in the case it was needed, with James Ellis not following Council Directives and issues of Enrolment files missing, Chief Summers acted on the Decision right after James Ellis refused a Council directive. Councilman Quick has the report on that issue.

50:50 Vice Chief Watson asked that personal comments be kept out of his arguments.
51:30 James Ellis states he is supposed to know of everything. Then starts in on an employee. James Ellis claims she is not part of enrollment. NOTE, Geneva Merritt had this employee do much of her work. James Ellis brings up issues which should legally be done in closed session. James Ellis claims he has evidence of wrongdoing but presents nothing.

53:07 Associates of the Defendant start yelling, James Ellis says, Woo, Woo, Woo. please let me read you an article here, I have the floor. Speaks on recall but refuses to listen to the fact our Constitution could put us in legal issues by mentioning employees in an open meeting and this issue was not on the agenda for her to be prepared for it. Also this employee had not been charges with any wrongdoing. James Ellis states this is not a hearing but concerns of himself. It has always been a meeting for the Western Cherokee, this is the first time a meeting was about James Ellis's concerns.
50:50 Chief Summers says people need to be removed if they cannot keep it under control.
54:00 Diane Dee says Chief Summers is wrong. NOTE, Chief Summers wanted to keep things under control, people were yelling, threatening riot, and the others thing which have happened by saying the people need to be heard.
54:00 James Gowan (Not a Member) starts yelling at Chief Summers, shoved a spear in his face.
54:50 Vice Chief Watson says James Gowan needs to be removed
55:00 James Ellis says no one is going to be removed, Tim Spencer says get control or I will. Deana Hennington ask to speak, Tim Spencer yells, who are you.
55:50 Vice Chief Watson tried to privately talk with James Ellis about our Constitution may violate civil liberty rights. James Ellis ignores him and says could you tell everybody but Vice Chief is not given the chance.
56:15 Carlo Carlino talks about anger. Asks Vice Chief to give these people the benefit of doubt.
60:25 James Ellis says his linage has been in question. NOTE, it was discovered by Geneva Merritt who told council members that Mr. Ellis did not have a file in the office. Another concern has arose to where James Ellis's holds his loyalty, the Western Cherokee or the WCNAM which we separated from in 2001. James Ellis runs a MSN web-site called Cherokee Nation Contact. He has had since 2001 to change the page called Enrollment List but to this date he still says he is a member of the Western Cherokee Nation Of Ar. & Mo. while there is a place to edit your information. 08:20 Carman McDonald (volunteer and helped Vice Chief in his store) show accountability and that James Ellis took blankets without paying for them. James Ellis admits to taking 2 blankets without paying.
11:05 James Ellis cut Carman McDonald off saying he was talking about accountability. Carman gets upset with Mr. Ellis because he is trying to sidestep the issue. NOTE, it was not a secret that Vice Chief was selling the blankets and there were no sales and no one asked about them. Just another thing to bring doubt in people minds.
11:10 Carlo Carlino supports James Ellis's feeling and mentions there needs to be a paper trail. NOTE, Carman McDonald was trying to show the paper trail but was ignored.
14:10 Vice Chief Watson speaks on his contributions to the Western Cherokee, about the allegations without evidence being presented.
15:00 Vice Chief Watson brings up the rumor Carlo Carlino started and James Ellis was spreading around. Vice Chief reads a letter from the people who Mr. Carlino said Vice Chief insulted.  NOTE, Read letter that was read by Vice Chief stating the rumor he started was false.

52:15 Councilwoman Emmons and Councilman Cover both make  motions to break for lunch. James Ellis ignores the motion. James Ellis calls on Gail McElfresh, Council votes, James Ellis ignores the vote.
21:50 Gail McElfresh (treasurer on suspension)  (See hour 5, 19:20 min. Roberta Miller) reads her allegations. NOTE, It has been a year and no evidence has been presented to the court or the people of any wrongdoing. She reads a letter from our CPA stating it as if it was the law.
26:25 James Ellis call for lunch break.
28:50 Gail McElfresh (treasurer on suspension) continues with allegations. NOTE, no evidence of wrongdoing was brought forward that day and today, a year later no evidence has been brought forward.
40:45 Geneva Merritt claims Vice Chief threatened a member. Vice Chief says he advised the member about he might wish to contact an attorney before signing the petition. Ms. Merritt claims Vice Chief threatened her in an email. NOTE, no evidence of wrongdoing was brought forward that day and today, a year later no evidence has been brought forward.

43:45 James Ellis talks about checking accounts and why the change of names was never done. Gail took the position of treasurer in Feb. 2006, NOTE, she placed her resignation later that month. Vice Chief makes it clear there have been no checks written that have not been authorized. NOTE, no evidence of wrongdoing was brought forward that day and today, a year later no evidence has been brought forward.
45:25 James Ellis makes allegation of misappropriation of funds concerning the RV and then admits did vote to pass the resolution. Vice Chief states James Ellis does not seem to be happy with the approvals that have been made. NOTE, no evidence of wrongdoing was brought forward and James Ellis admits to approving the funding.
47:10 Councilwoman Emmons, Cover seconds a motion to to adjourn into the Hearing of Allegations and Recall. James Ellis says no and those who have created trouble say no. James Ellis goes on to say we are deal with the Executive Order right now. Carlo Carlino says he hopes for a peaceful resolution.
48:30 Vice Chief Watson says he has no problem hearing the people, says there is a problem with the allegations with no merit because there is no evidence. Vice Chief mentions some of the people here have stolen records, tried stealing our web-site, and other things which we have proof of. Asks what is really trying to be accomplished here.
49:35 Tim Spencer (no records in office because his wife removed them) Charges Vice Chief w/Arrow, breaks it and throws it, hitting Chief and Vice Chief.
50:25 James Ellis about records that are missing making allegation of wrongdoing. NOTE, no evidence of wrongdoing was brought forward and James Ellis doesn't mention Shawna Ellis and Geneva Merritt were in charge of Enrollment.
50:40 Vice Chief Watson mentions that James Ellis wanted the employee he had all the concerns about to open the door to enrollment after Council said she should not be responsible for volunteers.

Carlo corners Vice Chief NOTE, Shawna Ellis is James Ellis's wife and Vice Chief cannot control herand those in Enrollment. Vice Chief says we are doing our best with our budget. NOTE, James Ellis and Gail McElfresh wanted access to Enrollment office after it was locked.
54:00 Vice Chief Watson tries to explain we are doing the best possible but James Ellis is always in the way. Carlo Carlino cannot seem to be made happy, but doesn't seem to care about that. Carlo believes the people who are causing problems should be heard when they will not listen to anything, they yell when things are said they don't like etc.
54:55 Carlo Carlino Carlo mentions resources of the tribe to cut people down and refuses to look at it being James Ellis which he admits to later when he says he used Voter Registration List to contact members to gain support. NOTE, This has been a problem for years, Carlo would say he gave something to someone in the governing body but would never mention the name if it is James Ellis leaving Council in wonder of whom it was. Carlo shows he had already made up his mind which is something an Elder never does without being shown proof. Carlo had been given NO evidence and will not listen to our Chief and Vice Chief.
57:20 James Ellis complains about how enrollment had locks put on the door. Carlo brings up Council not knowing the Constitution but claims they all said they never read it, this in not true to the words of Council.

47:10 Councilwoman Emmons reminds James Ellis she made a motion, James Ellis says, he didn't realize there was a call for a motion and ignores Ms. Emmons and goes on.
58:50 Diane Dee changes subject about the office being locked. NOTE, She knew the office was locked because James Ellis would not follow a Council directive.
60:20 Vice Chief Watson explains why the office is locked and why Council approved the office being locked. NOTE. It was due to James Ellis refusing to abide by Council directive.

00:00 Laurie Spencer yells at Vice Chief about money she claims she is owed her. NOTE, them spending money was never approved by Council. She then says she was addressing Council, trying to mock Vice Chief.
02:20 Janet Smith attacks Vice Chief about tee shirts he personally paid for out of his pocket and where is the money for them. NOTE, Vice Chief bought the tees and donated the money to the WC but we changed our seal and they did not sell. James Ellis knows we gave away the last of the tees at the previous Powwow but says nothing to stop the attack.
05:10 Lancer Blair reads a petition to remove five of seven officials, They claim they had roughly 100 people signed it but the petition. NOTE,  what they turned over to the court were typed names (no way to verify), not to mention there were minor children, non-members, and people who do not even know their name was being used and to even make it worse the petition is not within our WC Constitution. This is the first strong sign this was a take over attempt.  Eric Smith whispers something to Diane Dee.
15:15 Diane Dee says the people have finally had a voice. NOTE, The yelling voices being heard are those who walked away, took records and many others issues.
17:20 Carlo Carlino speaks about giving respect.
19:50 Heather Phomsavang (not a Member, cousin of James Ellis, daughter of Wanda Campbell) Makes issue of not being allowed in enrollment by an employee which Council said this employee should not be responsible for volunteers. Make claim of house being in bad condition NOTE, when they rented the house it was the agreement they to fix the home and only pay $200 per month but soon only paid $100 so the could make repairs. In on breath Carlo talks about security, then employees opening enrolment is an issue, he have been taught this is hypocrisy. Our Conclusion is there was nothing that could be presented to change anyones minds.
24:40 Carman McDonald (volunteer) tries to bring a point of order with Carlo Carlino. She brings up the Council being ignored by their motions. James Ellis answers and then uses our Traditional Principals as an excuse.
27:00 Bill Sischo makes comment about Vice Chief telling the truth that Elders Bea and Elmo was with Laurie Spencer when she took her files. NOTE, Bea admitted at a meeting she told Laurie to take them.

Deana Hennington (friend of Carlo and Diane) brings the issue she has not received her card after giving it to Carlo Carlino. NOTE, she gave it to Carlo  Carlino, who then gave it to James Ellis. Ms. Hennington blames Vice Chief for this issue. NOTE, Vice Chief never seen the information but did contact Shawna Ellis a year before that. (See email Vice Chief sent Deana Hennington explaining her card). (See Mr. Hennington's reply, not carrying about the truth of who had her information.) This is the point where they claim EVERYONE turned their backs on us but you can see this is not true.
37:05 Vice Chief Watson explains Power of Attorney and nothing illegal done. NOTE Carlo Carlino had a phone conversation with Councilwoman Emmons which explains he was talking on hearsay, Deana Hennington has not been involved or around in some five years or better. Vice Chief explains who he has sacrificed and is hurt how a few people have passed judgment without evidence. AND how people do not wish to hear the truth when it is sitting with the Council and they will not allow it to be heard.
40:00 Diane Dee talks about the people have not been heard in a long time when they are the ones who walked away. She says she wants answers to the questions the people are asking but they will not allow them to be heard. NOTE, The paper trail she speaks of would be coming from Gail McElfresh, Geneva Merritt, Shawna Ellis, James Ellis, Vice Chief Watson has turned over information that he had. PayPal account is mentioned in the report on the investigation. Again they do not want the to hear the truth. This talk comes from a person that is supposed to be non-judgmental until all evidence is presented and there was NO EVIDENCE presented that day. The small group would not allow evidence of Council and Executive Office to be heard.

48:20 Chief Summers Susie Bailey cuts into Chief Summers talking. Chief Summers talks about accomplishments this administration has been part of because people are saying nothing is being done, people interrupt. Susie Bailey interrupts and says Don't bring religion into this.

51:40 Chief Summers says there people are a disgrace for the way they are acting. Chief says he knows what is happening and Vice Chief is not acting on his own. Susie Bailey interrupts
54:20 James Ellis has a comment to make that he is not tooting his horn but he was part of the acquisition of the properties. (NOTE, no one said he wasn't, he is part of the administration. Admits Vice Chief works hard.

57:30 Carlo Carlino brings up the so-called intimidation Vice Chief made to a member. NOTE, Read original email which Carlo refers to which siad there could be legal issues about charging an employee in a slanderous way and in public, asking an attorney would be a good idea.

James Ellis CONTINUED on the petition. He claims he did not start the petition. NOTE,  Petition sent by email shows it started with James Ellis, to Geneva Merritt, to members which sent it to the Chief and Vice Chief showing they felt the charges James Ellis sent out was the political back biting and the "rumor mill" that is being fed by such rude and non Native behavior.. James Ellis says his due process was violated and people were upset
01:00 Vice Chief Watson brings it to the attention that James Ellis used the Voter Registration List after resigning from the Election Board to contact people to gain him support.
02:45 James Ellis admits he sent the letters and says he is entitled to the list. James Ellis says the letter did not mention specific names, it only mentions specific details. NOTE, read letter from James Ellis with allegations, naming specific people and has no merit.
04:35 Vice Chief Watson mentions Council has been ignored and is told Council was out of order. Out of order someone asks who has the Power of Attorney.
05:00  Chief Summers replies NOTE, (approx. 4 1/2 hours into a meeting, approx. 3:00 pm and Chief Summers still present)
05:20 Carlo Carlino goes into the Power of Attorney and how he could turn over his control. Vice Chief states the POA is limited and cannot be used without Chief Summers ok on every issue. We do not see the Court seeing anything wrong in the POA when the judge signed three court orders demanding them to turn property over. Things get out of hand
07:45 James Ellis calls for break without a vote of Council. The take over group and Susie Bailey and Wanda Campbell (admits on this video she was not a member, aunt of James Ellis) starts yelling.
17:20 James Ellis calls meeting back to order.
17:50 Gail McElfresh (treasurer on suspension) brings up what she wanted which was not approved by Council. NOTE, no evidence of wrongdoing was brought forward that day and today, a year later no evidence has been brought forward.
19:20 Roberta Miller shows Gail McElfresh's allegations have no basis from her experiences. Roberta mentions she talked with Ms. McElfresh and her comments allegations were not true. Roberta clears up that Vice Chief was not the reason she resigned as treasurer, it was Lisa Thompson that told her to come get the paperwork herself. Susie Bailey cut in.
26:10 James Ellis says he does not know what to do.
26:20 Geneva Merritt makes a motion for Council to take care of it.
26:40 Diane Dee says it is good to have heard the voice of the people. Talks about council walking out of the room after all their motions have been ignored. Asks that thing be done in an honorable way. Vice Chief Watson mentions the Recall Hearing for James Ellis and Gail McElfresh, she replies I asked you to do the honorable way and step down.. Vice Chief says he will pray about it.
28:20 Carlo Carlino says he offered to step down if our Chief, Vice Chief, and James Ellis step down. Mentions something about all of Council stepping down. NOTE, this would let people like Tim Spencer, Laurie Spencer and others who have done things that put the Western Cherokee in jeopardy. (Carlo points at Chief, approx. 3:30 pm and Chief Summers still present) He has offered to step down on several occasions.
36:50 Deana Hennington apologizes to Vice Chief and gives him credit for the donation of the Van. She admits she turned her back on the Western Cherokee leadership. Admits Vice Chief has never wronged her.
40:10 Vice Chief Watson speaks if he does decides to resign. Mentions his background of General Contracting and doing things right, in a professional way. Speaks on how he is hurt. Diane Dee says they have been waiting to hear the charges.
44:25 Vernon Strickland (member) asks to hear from Elder Horton, he recommends to put things off to the next meeting.
45:00 Elder Horton mentions allegations and if they have merit. Mentions the good things that have been brought out way with Chief Summers and Vice Chief Watson. How egos get in the way, and wants everyone to think about this. Someone asks about the trash bags.
48:35 Geneva Merritt says she brought in the trash. NOTE, After several minutes there is nothing found leading to Vice Chief doing wrong. Items in there were of Enrollment, Shawna Ellis and Geneva Merritt. Election which is James Ellis and Geneva Merritt. Heather Phomsavang (not a Member, cousin of James Ellis, daughter of Wanda Campbell) and Wanda Campbell (not a member, aunt of James Ellis) starts arguing and yelling. They try to blame Vice Chief for what was going on in enrollment and elections that he had no control over. NOTE, Nothing of importance is found nothing is said about Vice Chief Ordering the trash to be thrown away as they have publicly claimed. Lisa Thompson admits she is the one who discovers the trash and it is always shredded. NOTE, Here is the big question, IF Vice Chief was tampering with elections and enrollment, why did he have it thrown in the trash when there is a shredder and there would be NO evidence.
54:00 Carlo Carlino documents need to be filed. Everything becomes disorderly and no order is called by James Ellis. They are yelling and people are walking around, no truth can be found in this kind of environment. NOTE, it is starting to get late, the room is getting dark.
 


August 19, 2006, part 6 (60 min.) Real Audio

00:00 Meeting is still in disorder at approx. 4:30 PM, trash is being picked up. NOTE, Within the first 5 seconds Chief Summers voice can be heard which shows he was still present.

02:15 Carlo Carlino mentions the recall on the table and brings up the resignations. Investigations need to be impartial,  some of the allegations are true, some are not, some are half truths. Management of the office is not what it could be. NOTE, (Chief Summers and Vice Chief has been blocked by James Ellis and Gail McElfresh every time he tried to get the office running better)
07:25 Carlo Carlino points at Chief Summers which shows he was still present. Carlo brings up the Elders should know with investigations. NOTE, some Elders were being investigated due to all the times some of them covered for James Ellis. Carlo says he does not support banishment.
15:00  Chief Summers leaves around 4:45 to get back to take care ofa sick family member.
15:15 Vice Chief Watson asks that if he steps down he hope more respect is given to the next person who may take his place. Admits he is direct and at times hard to get along with. Vice Chief mentions that one on Council said that if one of them cannot be at a meeting, none of them would be. He has asked for enrollment to do things right and how Gail tried taking over enrollment. Vice Chief doesn't think people listen to the things they do not want to hear.
21:30 Elder Horton says he has never seen Vice Chief has never done anything intentionally wrong. James Ellis is shaking his head and says he is biting his tongue. How are we going to open the offices.
26:35 Vice Chief Watson will not be badgered by anyone to speak for another person, he cannot speak for others (reference to James Ellis demanding information of the Power of Attorney). They need to speak to the person directly. People need to stop using hearsay as a way to gain what they want.
36:50 Adrian (volunteers more than most members) Asks were the people were creating the problems today. were have they been when help was needed. There is allot of devotion from a few people and actions speak louder than words. He will not have his children around people who were like those that were here earlier.
32:20 Geneva Merritt the first thing we need to do is open the office. Vice Chief says we need to find a way to work this out and security is an issue. Carlo does not want anyone to make a decision anyone is uncomfortable with. Diane Dee says she is ready to walk away from this mess.
35:30 Vice Chief Watson mentions the book retired Elder donated to the Western Cherokee that she said was given to James Ellis. Vice Chief asks James Ellis if he has it, James Ellis says no, he only has the book he bought from her. Again Carlo says things which lean toward supporting James Ellis. NOTE, Over the years Carlo has mentioned he gave thing to the Western Cherokee but would not say who he gave them to, here Carlo says he did not donate them. James Ellis asks for his property that he never went to pick up, making excuses.
39:20 Elder Horton asks that we shake hands, James Ellis says he will not shake Vice Chiefs hand, he claims he done this twice in the past and Vice Chief violated it.
41:20 James Ellis says he tried talking with people and he is being charged (recall) for not doing this. NOTE, NO allegations has has ever been placed on the agenda on issue mentioned by him and his associated. Claims Vice Chief insulted his family.
42:55 Vice Chief Watson asks if James Ellis is late for most everything he says he will be there for, James Ellis explains and says he will not shake hands with Vice Chief. That his family has been disrespected. NOTE, James Ellis is ignoring the disrespected he has shown our Chef, Council and others on this day.
45:55 Carlo Carlino talks about finding resolution and James needs to work towards that, a sincere talk about getting things worked out. Tells James Ellis if he cannot, he needs to step down now. James Ellis  says he has to get his wife's permission.

Carlo Carlino makes a comment, so Quite Bear (James Ellis) will be stepping down, James Ellis says he is waiting for his wife, everyone waits for his answer.

00:00 Meeting is not order.
05:40 James Ellis walks over to where everyone is. Handshake takes place. James Ellis tells Council and others he will not work with or talk with Vice Chief. Therefore he violated his handshake immediately.
10:00 Carlo Carlino asks that the rubber stamp stop being used (Chief Summers signature). Vice Chief asks if he read the Power of Attorney, Carlo says no. Evidence Chief Summers did NOT RESIGN.
NOTE, NO ONE ON ELLIS'S SIDE WANTED TO SEE OT HEAR THE TRUTH ON THE POA, IT HAD RESTRICTIONS THAT WERE VERY STRINGENT
14:00 Carlo Carlino asks for vote, Council does not take a vote on the issue.
19:00 James Ellis SAYS HE IS GOING HOME


NOTHING IS SAID TO GIVE THE IDEA VICE CHIEF WATSON HAD RESIGNED. DEFENDANTS CHANGED THEIR STORY FROM VICE CHIEF BEING REMOVED TO HE RESIGNED.

 

Over the next week Geneva Merritt tells Vice Chief to unlock the door when Council had not found a solution to how this was to be done.

After the Office was emptied out. (9 min.) The offices were locked in July due to James Ellis refusing to abide by Council Directive and the recall charges filed on him but then they claim they had a key to open the door to remove your records from a locked office.
