On this day of June 26, 2007 the defendants and their associates have not abided by any court order. See court orders.

 

Everyone seems to consider themselves as honest but when we are given the truth, Creator gives us the choice to except or deny it. It is whether we except or deny the truth and our actions which follow, is what determines who we are as individuals and as a people.

 

If people accept actions of threats and intimidation as an acceptable way to a cause, are they saying they will accept them when it comes around to their turn.

Chief Jerry W. Summers did not resign.

Vice Chief John Watson was not removed from Office.

Council persons Jeff Cover, Ron Quick and Barb Emmons were not removed from council.

5. Video clips of August 19, 2006 meeting.

Here are some of the things your Chief, Vice Chief and Council had to put up with at the August 19, 2006 meeting which in reality was not a meeting but a small group that did not want the truth to be heard and when it was they changed topics and made threats.

 

* Evidence Chief Summers did not resign, if he would have resigned, why is there discussion after he has left due to illness in the family some 7 hours or better into the day? 2 min, 29 sec. (repeated below) RP Video

 

More evidence that Chief Summers did not resign. At the end of the day, one can see the sun is  setting and with the camera still recording why would there be  conversation about removing the Power of Attorney if Chief Summers resigned? 7 min, 04 sec. Anyone and everyone that knows Chief Summers knows he is an honest and caring man, anyone trying to say otherwise is misleading you. (RP Video) It would also be nice if they could make up their minds to when Chief Summers said he resigned. Eric Smith said in an e-mail "On AUG 19TH 2006 Jerry Summers was leaving and not coming back, this was entered into the minutes that he resigned his position. Then it was said by some of the same people "He also, on the same day, outside of council chambers and in the presence of twenty or more tribal members, did resign his office and renounce his responsibilities" The remained of this will be heard in court and then placed here for all to see.

 

* Evidence of threats made when Council makes a motion and Tim Spencer shouts "you want a riot" for Council warning James Ellis about bringing up employee issues in open session. James Ellis says "Tribal business stays open, not closed" and this is "concern of himself". Bringing up employees in open session is violation of labor laws and could make the Western Cherokee liable. James Ellis then states "this is not a hearing, this is concerns of myself"  1 min, 14 sec. RP Video

 

* Chief Summers tries to explains to James Ellis about returning of phone calls and he did talk with him, James Ellis cuts Chief Summers off while he is speaking. James Ellis does not seem to listen to Council explaining to James Ellis of previous conversations about the return of calls. James Ellis admits he has not brought things to Council. 3 min, 21 sec. RP Video (Not bringing issues to Council but going public before hand is part of what got him placed on recall.)

 

** Threat made of you control it or or I will after it is recommended that Jim Gowan be removed for putting a spear in the face of Chief Summers. Jim Gowan (not a member) was very disrespectful some three times through the day, at one point he sticks the spear in Chief Summers face. 1 min, 0 sec. RP Video

 

* Evidence Vice Chief Watson is accountable when Carman McDonald explains about accountability of Vice Chief Watson on things in his store, James Ellis admits to taking two blankets and has not paid for them. 3 min, 26 sec. RP Video

 

* Evidence of Carlo Carlino's honesty comes into question about telling people Vice Chief Watson insulted the Cook at the 2005 powwow. Council makes motion to break for lunch, voted on and ignored by James Ellis 6 min, 10 sec. RP Video

 

* Evidence Vice Chief Watson DID NOT misappropriate money when he explains the resolution for spending on RV, after James Ellis makes it an issue then admits to passing the spending. Council makes motion and is ignored by James Ellis. RP Video

 

* Vice Chief Watson reminds Council that two of the people speaking out were part of taking records out of the office with the help of an Elder and attempting to take our web-site a few years ago. Tim Spencer then charges forward breaking and throwing a spear at Vice Chief Watson, hitting Chief Summers. 1 min, 54 sec. RP Video

 

* Laurie Spencer tries to make it as though Vice Chief Watson is responsible and then admits it is Council she wishes to address when she is asking for refund of money never approved by Council. 1 min, 46 sec. RP Video

 

* Evidence of accomplishment when Chief Summers explains accomplishments with this administration, Jim Gowan (aka. Little Chief which is not a member) speaks back at the Chief, James Ellis states he is not tooting his horn. 8 min, 31 sec. RP Video

 

** James Ellis states he did not start the petition, and admits he used records of the Election voter registration to contact people, then states he did not use specific names in his letter. 4 min, 10 sec. RP Video

* Roberta Miller, former treasurer clarifies that she resigned due to Lisa Thompson not sending her the receipts she needed and Gail McElfresh was wrong when she wrote it was Vice Chief Watson which was the reason for her resigning. 2 min, 58 sec. RP Video

 

* Evidence Vice Chief Watson did NOT resign when he says he will pray on the idea of stepping down. 3 min, 17 sec. RP Video

 

* Evidence Wanda Campbell is not a member when she admits it but now is supposed to hold the position of Acting Chief/President with the group James Ellis brought in, Elder Horton speaks about progress of the Western Cherokee and the prayers needed. 4 min, 0 sec. RP Video

 

* Evidence the defendants has no evidence when Geneva Merritt speaks on the four bags of trash brought in, Vice Chief Watson asks why when there is nothing in them. The only piece of relevant information which was not in the trash was ballot that was postmarked some two months after the election. This should have been in the protection of the Election Dept. if relevant. Wanda Campbell (non member) starts yelling with a Eagle Staff present. 4 min, 58 sec. * Carlo Carlino offers to step down again if the Chief, Vice Chief and James Ellis resign. Chief Summers had already left due to illness in his family, how could Chief Summers resign if it is mentioned for him to resign again after leaving. * Vice Chief Watson speaks on if we resign and the future, speaks about when Chief Summers called a meeting and Geneva Merritt said if one of us can not make it there will be no meeting and Gail trying to take over enrollment. 3 min, 30 sec. RP Video

* Evidence James Ellis does not wish to work with Plaintiffs when James Ellis says he wants his property back when it was made available a few days after his suspending. He says he will not shake Vice Chief's hand. 1 min, 46 sec. RP Video

 

* If Chief Summers resigned why is there conversation about the power of attorney and Carlo asking for a vote to remove it? No vote is taken. James Ellis seems to say "I am done" when Council does not take an action on something they see no problem with. 7 min, 4 sec. RP Video (This is after the meeting and the sun is setting)

 

There were no official votes on anything after the reading of the minutes some 1 hour into the day, all motions were ignored.

 

Many of us believe, if these people are unhappy they can leave, we will give them their records and they can go on their way. They can leave but we will not give them what belongs to the Western Cherokee.
