James Ellis Recall Charges
In 2006 James Ellis was brought up on recall charges but got
around them by using threats of physical force and breaking into
offices and holding all property of the Western Cherokee and
making false allegations against the governing body. Again Mr.
Ellis is up on Recall charges

Pursuant to the Constitution of and for the Western Cherokee and
reserving unto ourselves the "Traditional Principals or
Tradition" clause of Section 6 to the Bill of Rights of and
for the Western Cherokee, we, the undersigned Cherokee Persons,
do hereby demand the immediate suspension from tribal and
corporate office, titles, duties and responsibilities, pending
the timely recall and subsequent removal from office, the
following persons, for cause:

Generalities and Specifications in support of the demanded
actions:
James D Ellis:
Ellis has continually and habitually shirked his tribal and
corporate responsibilities. Furthermore, Ellis has proven to be
inattentive to the needs of his office and of the Western
Cherokee people. Overall, Ellis's inefficient and
ineffective management style has proven to be a hindrance to
tribal progress. His mismanagement of the Tribal Services
Center has resulted in lost document(s and lost record(s), lost
revenue, and has compromised the Tribe and Corporation legally.
This coupled with the indigenous communities' negative
perception of the Tribal Services Center results in a less than
positive public image of the Western Cherokee.
Ellis:
Specification 1: Ellis did, and continues to; willfully
and knowingly violate both his oath of office and his
constitutional duties as defined by Constitution for the Western
Cherokee.
Specification 2: Ellis did willfully and knowingly violate
the rights of all Western Cherokee Tribal Peoples, rights
guaranteed in the BILL OF RIGHTS that is delineated in ARTICLE
VIII of and in the Constitution for the Western Cherokee as is
incontrovertibly evidenced by his executive order and/or
direction requiring that tribal and corporate records be
withheld from the Western Cherokee Peoples.
Specification 3:
Ellis did willfully and knowingly
use revenue inappropriately, did not oversee the timely
payment, and brought the Western Cherokee to disgrace by
allowing unpaid debts to accumulate to the point that debtors
had no recourse but to file suit against the tribe.
Specification 4:
Ellis did willfully and knowingly use aggressive language and
body behavior to intimidate tribal members.
Specification 5:
Ellis did willfully and knowingly interfere with a sanctioned
election by inappropriate contact with the Election Board and
Election Ballots.
Specification 6:
Ellis did willfully and knowingly fail to keep the Tribal
Services Center open to Tribal Members and failed to keep
communication lines open to Tribal Members.
Specification 7:
Ellis did willfully and knowingly fail to keep the Western
Cherokee Non Profit Corporation open to the public during normal
working hours as required by Missouri Law.
Specification 8:
Ellis did willfully and knowingly encourage Tribal Council to
Create The Pow Wow Committee to be autonomous(of another
government) from the Western Cherokee Tribe and the Western
Cherokee Non-Profit Corporation.
That he did willingly and knowingly encourage and allow
the Pow Wow Committee to Create debts under the name of the
Western Cherokee Non-profit Corporation using the Tax
Identification number assigned to the Western Cherokee Non
Profit Corporation in contradiction to the council’s order that
the Tax Identification Number assigned to the Western Cherokee
Non Profit Corporation no longer be used in any context.
Specification 9:
Ellis did willfully and knowingly ignore the debts created by
members of the Pow Wow Committee allowing them to compile
against the Western Cherokee Non Profit Corporation and the
Western Cherokee Tribe.
Specification 10: Ellis willfully and knowingly allowed Tribal
Council which must mirror the Board of Directors of the Non
Profit Corporation and must have a 3-5 quorum
to hold meetings and do business when a quorum was not
present.
Specification 11: Ellis willfully and knowingly has allowed the
Tribal Complex to fall into a state of disrepair by not
attending to the repair of the main and cafeteria buildings
roofs, by ignoring plumbing water leaks and allowing damage to
the cafeteria building, by ignoring City Notifications that the
grass must be mowed, by allowing trash and debris to pile up on
the exterior as well as interior of the cafeteria building.
Specification 12:
Ellis encouraged and obtained permission from the Council to
spend revenues as he saw fit.
Specification 13:
Ellis willingly and knowingly used the Tribal Complex to stage
his recent campaign without proper compensation.
