Invitations have been extended to Bill Linley, Paul Drew, and Paul Matheny to consider the open spot on the committee

Election Board Meeting 3 February 2002
Tim Sanders to send a letter to CNO introducing our Election Board, inviting them to send an observer and asking for any advice that may prove helpful.  To ask Elder Duke if he thinks it would be appropriate for him to make an initial contact letting them know we will be in touch.  Subject to Council approval.  Same letter (without request for ‘advice’) to Delaware tribe, Chickamauga, Floyd’s group, Carl Griggs, Beverly Baker.  MO and AR state auditors, some state legislators (perhaps at ballot counting point).  We should ask them to RSVP to let us know if they will be able to send an observer.  August 1 these letters should be mailed; CNO’s goes out March 1.  Tim Sanders to draft letter with Quiet Bear’s help, Quiet Bear to gather addresses.

Press should be invited, Quiet Bear will notify press.

Election Board approves timeline as submitted at Council meeting of January, including establishment of districts and ballot mailing process.

James Woods and Kim Thebeau to be in charge of maintaining an account of mail that comes into Potosi, and there will be a PO Box established in Potosi for conducting Election Board meetings.  James Woods will establish the PO Box before the February 9 Council meeting.

Spending limits:  Chief and Deputy Chief, $25000 from the time of filing.  Council, $5000.   Any unusable funds will be donated to the Western Cherokee or to a legitimate charity in the name of the Western Cherokee.  Cap for individual or corporate entity contribution to each specific campaign will be $250.  We will require candidates to fill out a form indicating all monies the campaign has spent and received; these accountings will be public information and published in The Red Path.  Filing fees for candidates are $100 for Chief or Deputy Chief, $50 for Council.  Mailing labels of registered voters will be sold to candidates, and the price will be set later.

No one may run for more than one office, and no current member of the Election Board may run for office.

Agreed that the only official information regarding the election will come only from the Election Board Chair.

James Woods will check on whether we can use the Potosi VFW Hall from 7am to 9pm on September 14 for ballot counting.

When ballots are sent out, envelopes will contain space for printed name and roll number.

Tim Spencer will draft a copy of the Voter Registration Form and Public Notice for submission on February 9.

Eric Smith volunteers to assemble the voter registration database.  James Woods will keep an account of how many registration forms are received, send them to Eric for data entry, after which Eric will send the forms back to James Woods.

Chief and Deputy Chief will run for four-year term.

COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE  3 TIMES

As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order.

What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
