Elder Dee expressed gratitude to the Pow Wow Committee

5.      Hearing of the People

Harris Glass presented a bid to replace all broken glass on the east, west and south sides of the building for a sum of $1602.71

Josh Fronterhouse expressed concern over the care of the property he donated to the nation. 

Motion by Councilman Ellis to notify Mr. Fronterhouse in 15 working days of our decision and to provide him with a time frame to remove his personal property, portable carport and storage shed

Annette Litherland reported an incident concerning tribal children and asked the Council and Elders to discipline the children

6.     Reports from

Family Preservation

Vice Chief Watson reported on the ?White Bison Project? taught by Larry Sellers.  Efforts are being made to bring this project to our community.

Enrollment

Progress entering data into the ?Legacy? program was announced. 

Election Board

Filing for election opens 31 May, 2005 and closes 1 July, 2005

The Election Board reported a need for funds to be allotted.  Vice Chief Watson suggested they prepare a budget for their needs, present it to Council and a poll vote would be taken

Restoration Committee

Reported on the many accomplishments achieved before Pow Wow

Events Committee

Jeff Cover will be organizing the 4th of July event and stated a need for volunteers. Contacts will be made to procure straw and a tent.

            Article III Western Cherokee Nation Board of Tribal elders

Section I Sentence?s 1 and 6 shall read:  Sentence I, There shall be a Board of Tribal elders composed of at least three (3) tribal members, but not more than seven (7) tribal members, who shall be at least forty (40) years of age and members in good standing.  ** Sentence 6, setting the appointment of recent elections

Motion to amend Article III Western Cherokee Nation Board of Tribal Elders, Section I, Sentence 1 to read There shall be a Board of Tribal Elders composed of at least three (3) tribal members, but not more than fourteen (14) tribal members, who shall be at least forty five (45) years of age and members in good standing.

 A meeting of all office volunteers will be called and mediated by Vice Chief Watson. This meeting will concern the identification and elimination of problems that slow progress.

A)  Making arraignments for a Powwow account.

Motion to accept Resolution # 050611 was made by Councilman James Ellis, second by Councilman Jeff Cover. Roll call vote Yea Councilman James Ellis, Councilman Jeff Cover, Councilman Bill Sischo, Chief Jerry Summers, Vice Chief John Watson. Ney 0. Absent Councilman Ronald Quick.

B)  Funding for Widows at the Cultural Center.

Motion to accept the donation to fix the windows at the Western Cherokee Cultural Center was made by Councilman James Ellis, second by Councilman Jeff Cover. Roll call vote Yea Councilman James Ellis, Councilman Jeff Cover, Councilman Bill Sischo, Chief Jerry Summers, Vice Chief John Watson. Ney 0. Absent Councilman Ronald Quick.

C)  Handling of funds and transferring of funds.

Motion to table till the next meeting or for a poll vote if need be made by Vice Chief John Watson, second by Councilman James Ellis. Councilman Bill Sischo asked about paying Tim and Laurie Spencer back for having the carpets cleaned at the Western Cherokee Tribal Services Center.

There was a motion to pay $50.00 of the bill today 6/11/05 made by Vice Chief John Watson, second by Councilman James Ellis. Roll call vote Yea Councilman James Ellis, Councilman Jeff Cover, Councilman Bill Sischo, Chief Jerry Summers, Vice Chief John Watson. Ney 0. Absent Councilman Ronald Quick.

Over $22,000 and no accounting for it!

COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE  3 TIMES

As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order.

What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
