2. Roll call of elected/appointed officials present (Confirm
Quorum).
3. Reading of Minutes from last meeting…
Out of order item, Chief Summers formally requests that
council reconsider and amend a policy resolution concerning blood quantum.
Chief Summers and the Tribal Council seem to be in total agreement of the
purpose and scope of the original resolution and a polling of the tribal
council reveals that all are in concurrence with Chief Summer‘s valid and
wise request to amend the aforementioned policy resolution to clarify it’s
scope.)
Matter now open for discussion, beginning with Chief Summers
for the Executive Department, followed by response first from Speaker of
the Council and then any other council members that wish to make a statement
.
PROPOSED CHANGE TO TRIBAL POLICY RESOLUTION AND 12/13/03
MINUTES: The Western Cherokee will not document Blood Quantum on the
membership card, nor shall a specific quantum be a definitive measure of
tribal membership eligibility, but Blood Quantum will continue to be
recorded in membership files. All members shall be considered to be
of equal blood by the Western Cherokee Tribal Government for the
purpose of tribal social standing. All Western Cherokee Laws, Regulations
& Directives shall reflect same.
After discussion motion should be made to accept proposed
amendment to both the minutes and the policy resolution if everyone still
agrees.

5. Old Business:
A) Second Reading of Constitutional Amendment for Enrollment
- Article VI Tribal Membership, section 3 Application Procedures. Wording
changed Committee chair changed to Department Director.
B) Placing Tom Collins on Council - Was tabled until
this meeting due to Mr. Collins not being present in December. Q&A Session
for Tom Collins by Elders, Executive Dept. and Council.
C) Continuation of tenure of Kelly Bernal for Council -
Was tabled until this meeting. Speaker reports Kelly states that
she can not continue at this time as she feels that her current circumstances
effectively exclude the dedication required for the post.
6. New Business:
A) Awards - Presented by Chief.
B) Discussion Item - Allocations and schedules of and for
fund raising events.
C) Discussion Item - What assistance/extra manpower can
the council divert to the Enrollment Department?
D) add a place for people’s e-mail address on enrollment
application for Executive contacting for events, and other info and if they
would wish to be added to the WC-Voice, include Voter’s Registration Form.
7. Closed Session to discuss:
Adopting a standard response regarding the Federal Court
decision.
State level recognition/acknowledgement?
Where do we want to go on the procurement of the old middle
school?
Is the Economic Development board still a bona-fide entity?
Are we (the council) ready to confirm them yet?
Tribal Land areas - All Pro Realty is gone, where do
we want to go now?

COURT RULES IN FAVOR
OF SUMMERS, WATSON & WESTERN CHEROKEE 3 TIMES
As of this date the defendants and their associates have
not surrendered Western Cherokee Property as
stipulated in two court orders and supported in the Stipulation and Order.

A court order did
state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true
officials of the Western Cherokee. This should clearly show the
defendants
and associates were wrong in their take over attempt but they continue to
refuse to abide by the Court Order. By a court ordered election which the
defendants controlled they are now legally in control of the Western Cherokee
future. Many people believe this ordered election was due to a filing by
Timothy
Spencer which was a threat of upward of 100 men, women and children would die
defending the property if the judge held his ruling.
