Meeting of the Council of the Western Cherokee Present: Chief Jerry Summers Elder Bea Foster 1. Call to order (Confirm Quorum) @ 11:45 by Chief Jerry Summers 2. Opening Prayer - Elder Bea Foster - Chief Jerry Summer ask for a moment of silent prayer for our troops - moment of silent prayer - Elder Elmo Foster ask if we could all say the pledge of allegiance to the flag - all say the pledge of allegiance. Chief Jerry Summers ask Council Member Tim Spencer to act as chair for council - Spencer accepts if no one objects. All present agrees. 3. Reading of minutes from last meeting - Kelly Bernal motion to accept the minutes, James Ellis seconds- all approve 4. Old Business a. Report of poll vote on funds for New Fire Ceremony. - Council Member Spencer - YES, 5. New Business a. Funding for the website - Deputy Chief Watson asked to speak about this, he gives all the amounts and for how long, Deputy Chief Watson also states that we just need to think about this cause it is due in November of this year (2003). Council Member Spencer ask if we can bring this back up at our next meeting in June. Council Members Bernal and Ellis agree, Council Member Bernal says she would like all council present to vote on this issue. Proxy for Council Member Sumner says Curtis if for it and we do need to keep our web site up. b. Discussion of Tribal Council Chair and Vice-Chair -Deputy Chief Watson ask that they consider change it to Speaker and Vice-Speaker, Council Member Bernal says she would like to bring this up at our next meeting when all council is present. Some discussion - Council Member Spencer and Ellis agree. c. Discussion of starting a list of potential Family Assistance Program within the tribe - Council Member Spencer ask Chief Summers and Deputy Chief Watson to go over this issue. Chief Summers ask Deputy Chief Watson to explain, Deputy Chief Watson says that this has come up, due to one of our families ask us for assistance. Chief Summers and I have been working with them along with Elder Woods and this is the solution that came out of communication so we can help our people. We would make up a list of names of parents that are certified or would like to be certified through the state. Then when asked if we know of any Native American Foster Parents we can send them a copy of our list. The state would be the ones handling everything, the tribe would not be involved in taking in, placing, the children and the state would be the one handling custody. Chief Summers ask if Council Member Bernal would help us by advising us in this area or with any other issue that may come up, Council Member Bernal said yes she would. Council Member Spencer motions to generate a list, but it must be done within each states guidelines and within their system. Council Member Ellis seconds, Roll vote take, Council Members Spencer, Bernal, Ellis and proxy for Sumner all say yes, motion passes. d. Discussion of other social projects the tribe can become involved in - Council Member Bernal mention the food programs that our group in Potosi does each year and that is make food baskets for those that need them during the holidays. Chief Summers mentions doing a Food Bank and that he and Nancy does one with their church. Deputy Chief states that we need to keep it within traditions and try to stay a tribal level and not on a larger scale. Council Member Bernal motions to start a food bank and any information we can get on it, all agree including proxy for Council Member Sumner. Motion passes. NOTE : Deputy Chief Watson mentions Chief Hundhausen’s of the Chickamauga’s Thank You Letter To the Tribe - Some discussion on the New Fire Ceremony. Some discussion on the June Gathering. e. Other New Business - Council Member Spencer mention that for the upcoming elections we put Chief and Deputy Chief on the same ticket. Council Member Spencer ask the Chief and Deputy Chief how they feel about it. The Chief and Deputy Chief both say they like the idea. Some discussion on it from council and members present and from Council Member Sumners proxy. Council Member Bernal ask for Elder Woods thoughts on the subject. Some more discussion on it. Chief Summers ask if we can take a lunch break at this time - all agree. Note: Laurie Spencer mentions that Candice Whinery sent the tribe a thank you card and that is was very nice, she will bring it to the next meeting to show everyone. Lunch Break @ 1:15 p.m. Meeting starts back @1:45 p.m. Council Member Spencer motions to have the Chief and Deputy Chief on a single ticket, Council Member Bernal seconds - Roll vote is taken - Council Member Spencer - yes, Council Member Bernal - yes, Council Member Ellis - abstains, proxy for Council Member Sumner - yes, motion passes. Council Member Ellis mention with Council Member Smith’s health problems that we offer her help by lightening her load. This way we are helping her plus getting our responses out to our members as quick as possible. Council Member Bernal motions getting the information switched over at the bank so that our Sec./ Treasurer has access. Council Member Spencer adds that Chief Summers be left as primary and Council Member Smith or Sec./Treasure Laurie Spencer could sign with Chief Summers and the statements to go to the Sec./Treasurer Laurie Spencer. Council Member Spencer seconds - Roll vote taken - Council Member Ellis - YES, Proxy for Council Member Sumner - YES, Council Member Bernal - YES, Council Member Spencer - YES. Motion carries. Council Member Bernal mentions that should keep the paper records in a separate location from the hard data copy just in case of fire or accident. Council Member Spencer motions that there is no prejudice or malice intended, how ever we do need to keep the paper copies and hard copies in a separate place with the Chairperson still having full accesses to the records. Council Member Ellis seconds, Roll vote taken - Proxy for Council Member Sumner - abstains, Council Member Ellis - YES, Council Member Bernal - YES, Council Member Spencer - YES. Motion carries. 6. Comments by Elders - Elder Woods talks about the New Fire Ceremony and that we should be Proud of our Chief Summers for his involvement even though he was very sick and Deputy Chief Watson for his efforts and how he handled things, and that he hoped that everyone attending got something out of it, it was a great weekend. . Chief Summers mentioned that the meeting with all the leaders that attended on Sunday went very well. 7. Comments by Council Members - Council Member Bernal mentioned that she got to speak with Richard and she was very pleased with what he had thought us and what he had to say. Council Member Spencer ask that we revisit the voting issue really quick and motions that for this election only (2003) that all the fees be cut in half (50%). Council Member Ellis seconds, Roll vote taken, Council Member Spencer - YES, Council Member Bernal - Yes, Proxy for Council Member Sumner - abstains, Council Member Ellis - YES, motion carries. 8. Western Cherokee Corporate Board Meeting Meeting called to order - @ 2:07 p.m. Present: (Roll Call) Not Present: Janet Smith, Tim Sanders Old Business: 1) James Ellis to present the information of grants. - Mr. Ellis goes over some grants that he found - some decision - Mr. Spencer motions that we go ahead and get the grants we can as long as we make sure what kind of strings are attached to the grant. Mr. Ellis seconds - Roll vote taken - Proxy for Mr. Sumner’s - abstains, Mr. Summers - Yes, Mr. Watson - Yes, Mrs. Bernal - Yes, Mr. Spencer - Yes, Mr. Ellis - Yes, Mrs. Spencer - Yes, Mrs. Smith & Mr. Sanders - not present, motion carries. 2) James Ellis to give information of how and where FEMA can help our people.
- Mr. Ellis states that we need to make an appointment with the chairman
of FEMA. Mr. Ellis also states that his research says that we will need a certified
CPA to help us and to show where all the funds went. Mr. Ellis did also find
out that the funds given to a certified company that if we already have the
items then the money can go to help maintain the building. - some decision -
Mr. Ellis says he is still doing research. 1) Discussion on starting a food bank & possibly clothing for our people who need them. - Mr. Summers says he thinks it would be a great idea and it could help our people as well. Mr. Watson says we need to look at this seriously and also see what kind of grants we could get to help with it. Mr. Summers ask when it comes to the clothes if we should charge a small fee all present agree we should, but we really need to check on it and some other issues first. 2) Discussion on how we can raise money for the tribe. - Mr. Spencer mention doing a auction with all proceeds going to the corporation for the tribe to use as needed. All agree that this is a great idea and that we should do it. All agree to start looking in their areas to help get items for the auction. 3) Community Awareness Program. - Mr. Watson says we need to let all churches, stores and other forms of businesses know what we are doing and that we are here. We should also show them what we are doing. Mr. Watson asked Mr. Summers if he could put something together for information for all of us to use, Mr. Summers says yes. Mr. Watson motions that we adopt the Community Awareness Program, Mr. Ellis seconds. Roll Vote taken - Mr. Summers - Yes, Mr. Watson - Yes, Mr. Spencer - Yes, Mrs. Bernal - Yes, Mr. Ellis -Yes, Proxy for Mr. Sumner - Yes, Mrs. Spencer - Yes, Mr. Sanders & Mrs. Smith not present. 4) Any other New Business - Opening a Corporate Office in Salem - Mr. Summers says we really need one so those donating to us don’t think we are just a fly by night kind of thing. Mr. Watson seconds - Roll vote taken - Mr. Summers - Yes, Mr. Watson - Yes, Mr. Spencer - Yes, Mrs. Bernal - Yes, Mr. Ellis -Yes, Proxy for Mr. Sumner - Yes, Mrs. Spencer - Yes, Mr. Sanders & Mrs. Smith not present. All agree that we need to make sure we have funds available to this but we do need one. They all agree also to see what kind of donations we can get to help us out with our corporate office. Mr. Woods mentions some land that he thinks we can get donated or buy it cheap, Mr. Ellis states that there are grants we could apply for to help us with the purchase. Mr. Spencer motions that we let Mr. Woods go forward with trying to get the land donated to us as long as the are no liabilities on the land. It is felt people have the right to know
According to emails and postings there are no minutes being
posted for any meetings since 2007
Even if it's not good new. Over $22,000 and no accounting for it! COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE 3 TIMES As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order. What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
