Meeting of the Council of the Western Cherokee
08 June 2002 Counsel Meeting
Poplar Bluff, MO

1. Meeting called to order at 10:15

Present are:
Chief Jerry Summers
John Watson
Janet Smith
James Ellis
Curtis Sumner
Eric Smith (proxy for Tim Sanders)
Shauna Ellis (proxy for Kelly Bernal)

2.  Opening Prayer – Curtis Sumner

3.  Minutes of 13 April 2002 Meeting – John Watson motions to accept the minutes, Eric Smith seconds, motion passes unanimously.  Out of Order Item:  Elder Bea Foster asks that William Sumner be placed on the elder board.  Mr. Sumner tells everyone about himself.  Elder Elmo Foster asks if he is Cherokee?  Mr. Sumner says he is Cherokee.   John Watson asks him if he is comfortable talking with people? Mr. Sumner says yes he is.  John Watson also asks him if other religions would interfere with his decisions?  Mr. Sumner says no it wouldn't.   James Ellis states that we need to table the issue for now until Kelly Bernal is present. John Watson motions to take a vote with Kelly Bernal’s vote pending, Janet Smith seconds, everyone votes to take a vote.  Motion to accepted Mr. William Sumner as an Elder with Elder’s approval.  James Ellis asked to speak with Jerry, John and Janet before the vote is taken.   Chief Jerry Summers calls Elder Duke on the phone.  John Watson withdrawals his former motion until all the Elders get a chance to know Mr. William Sumner.  Janet
Smith seconds, motion passes unanimously.

4. Treasurer’s Report – Janet Smith gives report

5. Report by Enrollment Committee - Janet Smith said everyone loves the new cards and the request keep coming in every week to get their cards re-issued.  Janet also states that she is keeping everyone on a database on her computer with notes if the member is deceased or if they asked to be removed.

6. Report by Election Board – Eric Smith asks to table the procedures due to the fact they are still being worked on.  Eric also states that the election board would like to have some more volunteers.  John Watson motions to table, Janet Smith seconds, motion passes unanimously.

7. Old Business:

a) Payment of recurring bills – Janet Smith mentions P.O. Box rentals and photo ID cards.  Money is collected at the time the photo ID cards pictures are taken, then they need to be paid for.  P.O. Boxes – Janet says that we have one for the enrollment committee (Dexter) and one for nation (Poplar Bluff).  Eric Smith says we also have one for the voters register station. John Watson motions that all P.O. Boxes be approved and paid automatically when they come due.  Curtis Sumner seconds, motion passes unanimously. John Watson also states that photo ID cards are paid for in advance so they would get paid for automatically.

b) Consideration of DOPS tabled from last meeting – Eric Smith motions to table until next meeting, James Ellis seconds, and motion passes unanimously.

c) Discussion of Election issues tabled from last meeting – Elder Elmo Foster asked when the election would end?  Elder also asked if we would start our election and the end of the U.S. elections.  Janet Smith states that we had already agreed to work it that way.   James Ellis states concerns to be held in odd years.  Eric states that it is already stated in the Election procedures. James Ellis motions to table election staff until next meeting, John Watson second, motion passes unanimously.

8. New Business:

a) T-shirt purchase – Janet Smith ask that John Watson and her mother be reimburse for shirts and ask that the nation buy them from now on.  The funds would come out for the purchase of the shirts and the profits would go back in to the checking account.  This would make the bookkeeping easier as well.  John Watson ask that the Elders and council members be able to check out a dozen shirts at a time to take with them to different meetings.  John Watson motions to table T-shirts until he goes over 8b, James Ellis seconds, and motion passes unanimously.  John Watson asked how it was going with the 501.c3 & 509. John Watson motions to let Chief Jerry Summers talk with Mr. Eats about this and get it working and going.  Then Chief Jerry Summers could return to us with information.  James Ellis ask that we be able to do a poll if necessary.  John Watson states that that’s already a given.  509-C6 & 501.C3.  Chief Jerry Summers states that Mr. Eats said he was Cherokee. James Ellis modifies motion so Chief Jerry Summers can start the paper work and get back to the council, Curtis Sumner seconds, and motion passes unanimously. John Watson motion to purchase T-shirts from Mrs. Sadler and he will wait until next month for his money to be reimbursed to him, James Ellis seconds, and motion passes unanimously.

b) Consideration of new council members (if any)  - No applications turned in at this time.

c) Discussion of the new web site: Western Cherokee.com  - John Watson states that Tim & Laurie Spencer purchased Western Cherokee.com and asked what were their intentions for the web site?  The Spencer’s told the council and Elders that they bought it to donate it to the nation and for the nation to do with it what they thought was best.  John Watson states that the web site at .org is for tribal business and .com is more public site. (Approved). Elder Elmo Foster would like to get all the information out to our people.  Eric Smith states that a gentleman contacted him and stated he would like to donate a web site to us for “The Red Path” – the gentleman’s name is Kevin and he is building the web site – the-red-path.com and donated it to the tribe, tabled

d) Discussion of forming a Community Awareness Committee – John Watson would like council to form a committee with the basic idea to go out and find out who is having a meeting and where then let Chief Jerry Summers know so he and other council members could try to attend these meetings.  Also this committee would go out and start community meetings. John states he would like to see 2 volunteers from AK, OK, MO for a total of 6 people.  John also states that we could hold meeting in AK. But our nation cannot be moved there.  John said he doesn't want council members on this committee or others already volunteered somewhere else unless they resign their positions first. Needs to start out as a committee then hopefully build into a department of it’s own within the nation.   John motions to form this committee so that council, Elders and Chief Jerry Summers can start getting people for it and so that they can get the procedures down for the committee - this committee will not call council meetings & will not have any legal authority just looking for places to hold meetings.  James Ellis seconds, and motion passes unanimously.

e) Other New Business: 1) About enrollment cards- Janet states that with an affidavit stating that this is their roll number.  James Ellis states about a T number starting at 50,000 until we have our records back – this if for those who lost there card and don’t know there numbers.  Janet Smith motion to add it to policy of enrollment committee to stat that lost card of members who don’t know their numbers be given a TR number (temp reused) until verification. James Ellis seconds, and motion passes unanimously. 
2) John Watson states that the tribe needs a historical historian for our nation.  The information needs to be given to the nation and a copy to the Chief.  James Ellis asked Chief Jerry Summers to invite Mr. Tim Jones back to talk with us again.  Chief Jerry Summers says ok.

Adjourn – for lunch at 11:54pm
James Ellis motion to break for lunch, Eric Smith seconds, and motion passes unanimously.

Meeting reconvenes at 12:49pm

8 e) 3) Member Mrs. William Sumner asked what are we trying to do?  John Watson and Chief Jerry Summers and Elder Elmo state that we are trying to get recognized as a nation.  And we have to show them that our people recognize us as the true council and Jerry Summers as our Chief.

10.  Comments by council:  James Ellis announces that 29 June 2002 in Dent County at the park will be a gathering, just for fun and also member of the tribe can get some information at the same time.      Please remember Elder Callahan and his family in their time of grief.     Eric Smith mentioned the gathering and that he made another appointment for next year for the 2nd weekend of June 2003 on the 13th, 14th and 15th.

Over $22,000 and no accounting for it!

COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE  3 TIMES

As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order.

What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
