Meeting Of the Council of the Western Cherokee
Minutes of 04/13/02   Council Meeting

Executive Session 10:00 - 11:05 (Closed)

A. Present are:  
Elders - John Red Hat Duke, Bea Foster, Elmo Foster, Jerry Summers (Acting Chief)
Council Members - John Young Buffalo Watson, Tim Spencer (Proxy for James Green), Janet White Fawn Smith, Eric Thunderbird Smith (Proxy for Tim Sanders), James Ellis, Kelly Bernal, Curtis Sumner.

Council Meeting

1. Meeting opened at 11:10 am (Called to Order)

2. Opening Prayer - Elder Duke

3. Reading of minutes from last meeting 03/09/02:
John Watson motioned to accept the minutes as written, Janet Smith seconds. Motion passes unanimously.

4. Treasurer’s Report - Janet Smith gives report, John Watson motioned to accept,  Tim Spencer seconds. Motion passes unanimously.

5. Report by Enrollment Committee - Janet Smith reports that she received 22 new applications since last month.

6. Report by Election Board - Eric Smith, Election Board Chair, reports that plans have been finalized. 

7. Old Business:

A. Consideration of Policy and procedures by Sergeant At Arms - Tim Spencer asked that this issue be tabled until next meeting.  John Watson makes a motion to accept the proposal, Kelly Bernal seconds. Motion carries unanimously. 

B. Status Report of Department of Public Service and personnel Resumes’ - Tim Spencer asked that issue be tabled until next meeting, John Watson so moves,  Kelly Bernal seconds,  Motion carries unanimously. 

C. Comments by Elders regarding Elections - Bea Foster, states that Elections are put on hold until everything is together and we get our records back, that it may take several months before we can get the elections back on track. 

D. Discussion of Elections issues tabled from previous month - Eric Smith informs Council about procedures and states he would like voter registration forms without a due date put on the web site and handing them out to members. The number of seats tabled until next meeting.  Eric Smith asked that Elections be held on odd number of years.   John Watson moves to table issue until next meeting.  Janet Smith seconds. James Ellis abstains.  Motion passes with 6 yea votes and 1 abstention.

E. Discussion of Oath - Janet Smith makes a motion that it’s a constitutional issue, John Watson seconds, motion passes unanimously.

F. Discussion of the Constitutional Committee - John Watson states that we need to reestablish a new committee that can work on it. Janet Smith motions to reestablish a new committee. Eric Smith, proxy for Tim Sanders, seconds. Motion carries unanimously.  John Watson motions to dissolve the Constitutional Committee for now, Eric Smith seconds, Tim Spencer abstains.  Motion carries with 6 yea votes and 1 abstention. 

G. Discussion of town hall meeting in Oklahoma - Elders suggest we table it for now until some of the issues/matters at hand are settled. Tim Spencer reads James Green's “quote” - “At the appropriate time and when we are approached by a reasonable number of Tribal member (More than 10) I will support a Town Hall meeting”. Eric Smith, proxy for Tim Sanders, motions to table until some issues are settled, John Watson seconds.  Tim Spencer abstains. Motion passes with 6 yeas and one abstention.

H. Discussions of Public Relations position for the people -  No action taken.
I. Appropriation for Enrollment Committee - Janet Smith ask for $75.00  funding for the enrollment committee for the next two months (postage, envelopes, paper).  Tim Spencer motion to appropriate $75.00 to the Enrollment Committee. Curtis Sumner seconds.  Motion passes unanimously.

8. New Business:

A. Discussion of replacement Enrollment Cards/cost for reissue - Janet Smith talks about reissuing of cards and if council approves they will be laminated. Elder Duke suggests that the cost be $5.00, due to the increased volume of members asking to get new cards (blue business card paper with lamination) to cover cost.  (These cards are not ID cards that are hard plastic) The $5.00 charge will start as of today’s meeting (04/13/02). Those members whose requests have already been received will still be able to get their cards reissued at no charge.  Notice is to be put on the web site with the price.  A copy of the front and back of the enrollment card must be sent in with the request for a new card.  In the event of a lost card, the member must send a notarized statement along with their Roll Number. Cards will not be reissued without roll numbers. Janet Smith motions the $5.00 fee as long as we have copies of the front and back of their cards. Tim Spencer, proxy for James Green, seconds.  Motion carries unanimously.

B. Consideration of new council members (if any) - No resumes’ submitted.

C. Appropriation for I. D. cards - Janet Smith asks for appropriations to pay for I. D. cards. John Watson motions . Tim Spencer, proxy for James Green, seconds,  Motion carries unanimously..

D.  Discussion of Welcoming packet for new members - Janet Smith asks on behalf of the Enrollment Committee to do a welcome packet for new members.  In the packet will be a listing of the Governing Body, the web site URL, a copy of the Red Path subscription form and a copy of the Voter Registration form to be mailed out with their enrollment card. James Ellis motions to accept welcome packet, Curtis Sumner seconds.  Motion carries unanimously.

E. Appropriation for May gathering and ceremony - On May 17, 18 & 19, 2002 at Lake Wappapello. Due to limited space you must call and sign up for it ahead of time. There is about 8 spaces available for RVs. There is a fire ring, pavilion and dinning hall. You’ll need to bring your own food and bedding (bedding for those staying in cabins). The cost is:  $6.00 per person overnight,  $2.00 per person for the day ONLY.  Eric Smith states that there is a refundable $100.00 deposit to reserve the park for us for those days.  John Watson motions to appropriate the $100.00 check for deposit to the park. James Ellis seconds,  Motion carries unanimously. It is mentioned that this is a drug free, alcohol free event. 

F. Website Administrator clarification of events posted on Nations site - Elders and Council agree it should be Nation Business Only.  Please check with John Watson to have items placed on the nation’s web site.

G. Other new Business

1. Elmo Foster asks that our meeting be every 2 months instead of every month.  Janet Smith states that our next meeting should be at the gathering.  John Watson states that we should schedule it in 2 months. Kelly Bernal motions, John Watson - second,  Motion carries unanimously.. 

2. Janet Smith tells about the merchandise with our seal on them for fund raising.  There are T-Shirts, ball caps, mouse pads and buttons. John Watson motions to adopt the added amount agreed upon for all items.  Eric Smith, proxy for Tim Sanders, seconds,  Motion carries unanimously.
A. List of items for sale:  (with tribe seal)

T - Shirts  $15.50ea. XX & XXX Sizes  $17.50ea.
Mouse Pads $13.50ea.
Ball Caps  $ 9.50ea.
Buttons  $ 2.25ea.

3. Betty Jo Anderson ask that if anyone has any recipes for the old ways of cooking and medication.  She asks that they be sent to her for a book she is doing.  Please e-mail or snail mail to information: Betty Jo Anderson, 216 East Medland, Poplar Bluff, Missouri 63901. 

        Submissions should include from where and who they were obtained. 

4. Carlo Hawk Walker Carlino mentions concerns regarding proxies at the Council table.  Council and Elders address his concerns. 

5. John Watson went on record to state that since Tim Sanders is on a leave of absence at this time. Laurie Spencer will be filling in for Tim as secretary in his absence.

9.  Comments by Elders - No comments.

10. Comments by Council - Curtis Sumner reminds everyone of the need to come together in unity and expresses his gratitude to everyone who attended the meeting today. 

11. Concerns of Membership - No comments

12. Closing Prayer/Adjourn - Bea Foster gives closing prayer.

COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE  3 TIMES

As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order.

What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
