Minutes of 10/06/01 Tribal Council Meeting 1. Call to order (Confirm Quorum)
3. Reading of minutes from last meeting August 11, 2001. Michael Greene reads the minutes. James Green moves to accept the minutes, John Watson seconds, motion passes unanimously. 4. Introduction of Special Guests. James Ellis introduces the Kathy Jones, Chief of the Amonsoquath Cherokee and Sherian Hundhausen, Chief of the Sac/White River Band of Cherokee. 5. Remarks by Guests [these
occurred at various times throughout the meeting] 6. Ground rules for meeting. [Agenda item skipped] 7. Financial Report (Treasurer/Chief) a. Report of Expenses b. Report on Storage of Records Took in $18 at the last Council meeting, went toward storage. At a meeting held in TN, $55 was collected and sent to storage. No money in treasury, Lee reports a net of $132.94 owed for office expenses and $502.21 for storage. 8. Report on legal action taken to intercede in the Turman lawsuit. Michael Greene reports that the lawsuit was dismissed without prejudice. James Ellis clarifies that the judge indicated that this issue needs to be worked out within the group. John Watson responds with a call for further action. Bea Foster asks the Council to nominate Paul Drew to the Board of Elders. James Jones recommends among other things that we change our name to the Western Cherokee Nation, and that in time we combine with the other bands to form a council of chiefs. 9. Old Business a. Report by Constitution Committee. b. Amendment to new Constitution c. Adoption of new Constitution as a working document John reports little progress since the last meeting, but says the committee will have a document ready to look at by the December meeting. John moves to table adoption of the Constitution as a working document until December; James Green seconds and the motion passes unanimously. d. Report by Enrollment Committee Janet reports that the committee has tentatively approved an application form and will present it to the Council in December. Break for lunch at 12:03 James Jones makes a remark about arranging for ceremonies. Lee Overturf recommends that people make an effort to participate in ceremonies. Murl Pearson moves to allow the elders to set time and place and preparations for ceremonies. Janet Smith seconds and the motion passes unanimously. 10. New Business a. Consideration of new Council Members b. Discussion on reorganization c. Newsletter Tim Sanders moves to form an election committee. Tim Jones discusses some issues relating to having elections. James Green amends the motion for the committee to consist of Tim Jones (non-member advisor), Tim Sanders (chair), James Ellis, and Don Collier, as well as other members whom the committee may appoint. John Watson seconds and the motion passes unanimously, with Tim Sanders abstaining. [agenda item (a) amended to read "Enrollment Committee Members"] Lee Overturf recommends we place Marjorie Pierson on the enrollment committee. After some discussion, Janet Smith so moves; David Householder seconds and the motion passes unanimously. Eric Smith describes the newsletter he publishes and how people may acquire a subscription. He asks all tribal officials to send a biographical sketch so that he can print information about them in the newsletter. Eric volunteers his services to the tribe in writing a monthly newsletter. John Watson moves to commission Eric to write a monthly newsletter on behalf of and overseen by the Nation, with a yearly paper subscription rate of $10. David Householder seconds, and the motion passes unanimously. Eric assures the Council that subscribers' privacy rights will be maintained. John Watson reads resolution 100601a. Murl Pierson asks why we cannot use the name Western Cherokee Nation in the resolution, and James Green explains that this name would create undue confusion with the CNO. Tim Jones makes a suggestion to add a note of purpose and intent to the top of the document. James Ellis moves to accept the amended resolution. Murl Pierson seconds, and the motion passes unanimously. The elders concur with the resolution. John Watson reads resolution 100601b. John Watson moves to amend the document to state that "the name for said corporation shall be determined later" [final paragraph] and the second to last paragraph shall read "Furthermore, be it resolved that the Western Cherokee as defined in Resolution 100601a, and not the authorized corporation, shall be the custodian of any membership records", and to accept the amended resolution. James Green seconds, and the motion passes unanimously. James Green moves to have David Householder replace Kenneth Householder as Treasurer. Janet Smith seconds, and the motion passes unanimously. John Watson reads resolution 100601c. Tim Sanders recommends sending the document to the Constitution Committee. Lee Overturf recommends that the committee that prepared the document spend some more time on it. Tim Jones recommends that such an amendment be voted upon by the people. Elmo Foster recommends that the Council take some time to consider the issue. 9. Comments by Elders
James Jones speaks in favor of ending communication with them and the faction they are associated with. Bea Foster speaks along the same lines. Elmo Foster speaks in support of John Duke. 10. Comments by Chief

According to emails and postings there are no minutes being
posted for any meetings since 2007
Even if it's not good new. Over $22,000 and no accounting for it! COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE 3 TIMES As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order. What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
