Minutes of 05/19/01 Tribal Council Meeting Meeting opened at 10:28 am Absent without proxy are AJ Glover and Sandra Counts ***Unless otherwise specified herein, “motion passes [or carries] without opposition” means Janet Smith abstained from the vote on behalf of Carlo Carlino as did Michael Greene on behalf of Paul Matheny Elder John Duke opens the meeting with prayer James Greene moves to waive the reading of the minutes, Paul Drew seconds and the motion carries without opposition Lee Overturf reports on financial matters and the status of
record storage * Any money taken in at today’s meeting will be applied to the storage bill John Watson moves to accept the treasurer’s report. Ray Denison seconds and the motion carries without opposition Michael Greene reports on the lawsuit filed by Harold Turman. There is disagreement between Mitch Stein and Randall Miller as to what the nature of the lawsuit is. Michael Greene reports that things should be resolved quickly but he has no specific information he can provide at this time. He assures the group that as events can be disclosed they will be announced on the website Tim Jones gives a report on his work in visiting with state legislators and university presidents, and shares a positive message for the future. He recommends that we need to get our voice out to the membership in a greater way. He mentions some of the work he has been doing researching the history of the Western Cherokee and the many related groups John Watson moves to recess briefly so Dr. Jones may speak off the record, James Greene seconds and the motion passes without opposition John Duke addresses the council briefly on spiritual and political issues, and where he wants to see the Nation go Constitution committee members speak briefly on the progress of the Constitution, sharing some of the philosophies that are going into the revision The meeting adjourns for lunch at 12:34 The meeting is called back to order at 1:47 Lee Overturf explains that AJ Glover and Sandra Counts have been notified of their impending removal from the Council for excessive absenteeism. Tim Sanders moves to remove both AJ Glover and Sandra Counts from the Council, Ray Denison seconds, and the motion passes without opposition (Janet Smith in proxy for Carlo abstains) Jan McDonald moves to place Grover Barbie on the Council, James Greene seconds, motion passes without opposition (Janet Smith in proxy for Carlo abstains). Lee Overturf administers the oath of office Ray Denison proposes to rent a Post Office box in Lake City for the Nation. Hugh Thompson seconds and the motion passes without opposition Lee Overturf volunteers to allow his home phone number (901-837-7516) to be used as the official phone number until we get an office set up Ray Denison moves to extend Lee Overturf’s term as Interim Deputy Chief for an additional 90 days. Art Cook seconds, and the motion passes (James Ellis abstains and Janet Smith in proxy for Carlo Carlino votes no) John Duke makes a proposal regarding how to handle enrollments Paul Drew moves to amend the previous resolution so our address will be Lee Overturf’s (208 Country Meadow Lane, Atoka TN 38004) for now instead of acquiring a post office box. Jan McDonald seconds and the motion passes without opposition
James Ellis moves to reinstate the guest book on the website, with the stipulation that entries without valid contact information or with derogatory or slanderous comments will be removed. Tim Sanders seconds and the motion passes without opposition (Paul Drew, Michael Greene, and James Greene are absent for the vote) James Ellis moves to open a satellite office in Salem. After some discussion, Lee Overturf moves to table the discussion to the next meeting, Jan McDonald seconds. Motion passes (Hugh Thompson and James Ellis opposed) Elder Jim Jones speaks briefly about preserving our identity and culture Next meeting will be June 23 Meeting is adjourned with prayer by John Duke at 3:37

According to emails and postings there are no minutes being
posted for any meetings since 2007
Even if it's not good new. Over $22,000 and no accounting for it! COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE 3 TIMES As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order. What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
