Minutes of 04/07/01 Tribal Council Meeting John Duke opens the meeting in prayer Paul Matheny calls the meeting to order at 10:33
Present are: · Various assembled elders and guests Paul Drew moves to forego the reading of the minutes, Tim Sanders seconds and the motion passes unanimously Elder John Duke gives a report on the Ceremony of the New Moon on March 30-31. Elder Duke mentions that he would like to do what he can to help people discover more of their heritage. Carlo Carlino reports on the role of the sacred fire in the Ceremony. Paul Drew makes a point to thank Tammy and Shawn Haynes, as well as the Mayor of Pocahontas, for helping to secure the location for the Ceremony. Paul Drew moves to accept Lee Overturf's resignation from the Council, Carlo Carlino seconds and the motion passes unanimously. Lee Overturf gives a financial report on behalf of the Treasurer:
Paul Matheny offers the Elders and Council a chance to speak to the issue of recall of Lola as Principal Chief. · Each of the Elders who are present comment on their vision for where the tribe needs to go. · Fred Bryant, Elmo Foster, Bea Foster all make it clear that selection of a new Principal Chief must only occur with a vote of the membership. · Carlo Carlino, James Ellis, Art Cook, Michael Greene, Paul Matheny, Tim Sanders, and Paul Drew speak. · At Paul Matheny's request, Mike Harmon gives a complete accounting of all funds that ran through the Nation during 2000. Several loans and payments were made to Lola's family members and others. · At Paul Matheny's request, John Duke comments on Lola's offer to sell our rolls to the Cherokee Nation of Oklahoma.
Paul Matheny restates the specific charges against Lola:
Paul Drew Moves to permanently remove Lola from the office of Principal Chief, Carlo seconds. A roll call vote was taken, and the motion passed unanimously. Old Business: He has written a letter explaining what we need, and they will contact us once they complete a 'memorandum of understanding'. Paul will forward this to the Council when it arrives. · Paul Matheny reports that the records are still in storage under the possession of the Elders. He explains that there is plenty of security and that the files will remain there until the new office is set up. · Lee Overturf reports on the request for investigation regarding the 501c3 and child welfare. The IRS office in Memphis was asked to close the 501c3 so we can start a new one. Lee talked to someone in human services in Little Rock; he believes there are 30-40 children who are placed in inappropriate situations. John Duke presents evidence of the alleged inaccuracy of Lola's genealogy, including ancestry lists and affidavits. Lee Overturf nominates the following to fill vacancies on
the Council: Without objection the meeting is recessed for lunch from 12:10 to 1:30. Paul Matheny reads resignation letters from several tribal members; Mike Greene moves to accept these resignations, Paul Drew seconds. Carlo Carlino suggests that we shouldn't be quick to remove people from the rolls without some stipulation for the possibility of reinstatement. Tim Sanders suggests that accepting resignations should be an executive function of the membership or enrollment committee rather than the Council. A suggestion came from the audience for us to send letters to these people trying to keep them as members but still offering them removal from membership if they send in their card. The Council decides to have the enrollment committee take care of these issues. Carlo Carlino moves to reinstate the enrollment committee,
James Ellis Paul Matheny reads Diana Spurlock's resignation letter from
the Council. Paul Matheny mentions that AJ Glover and Sandy Counts have failed to appear or send proxies to the last two meetings. Due to their neglect of duties, Lee Overturf will send a letter informing them of their impending removal at the next meeting if they fail to appear. Carlo suggests Sandy's letter also include mention of her alleged ineligibility to serve on the Council due to John Duke's research into Lola's lineage. Jan McDonald recommends Jim Jones to the Board of Elders and she and several others speak favorably of him. Mike Greene moves to appoint Jim to the Board, Paul Matheny seconds, motion passes 8 to 0 with 4 abstentions (John Watson, Tim Sanders, James Ellis, Carlo Carlino). The meeting is suspended briefly as Elder John Duke performs
a naming Mike Greene gives a report from the Constitutional Review Committee. The committee is working to overhaul the Constitution into a usable form. We have a draft of an updated Constitution in place now, and will have the document in its final form ready to be ratified in time for the election. Mike Greene explains several of the improvements in the new document, explains that it will be available on the web page next week, and solicits ideas from the members. At next meeting we will discuss the idea of operating under this working document. Mike Greene asks Carlo Carlino if he would like to be on the Constitutional Review Committee, and Carlo agrees. Carlo Carlino moves to place the draft version of the Constitution
on the web, John Watson seconds, and the motion passes
unanimously. James Ellis, Mike Greene, and Carlo Carlino each speak briefly. Carlo Carlino moves that we do not turn over to Harold Turman any information on Harold's lawsuit against Lola, and we neither sanction the lawsuit nor claim affiliation with the suit, Ray Denison seconds and the motion carries unanimously (Kathy Householder is out of the room at the time). James Ellis reports on the web page, and John Watson speaks briefly on the matter as well. Carlo Carlino moves that the Council release the following statement: "The Council of the WCN no longer endorses the Cherokee Chronicle due to its feeling that the Chronicle provides inaccurate information regarding the business of the Nation." Jan McDonald seconds, and the motion passes unanimously. Carlo polls the Elders, and they are in unanimous agreement with this directive as well. James Ellis asks to move into a closed session to discuss the issue of state recognition. Carlo Carlino closes in prayer. Next meeting is May 5; meeting is adjourned at 4:25. Executive Session held following regular Council meeting, minutes are to be released upon close of the Missouri legislative session this year.

It is felt people have the right to know
According to emails and postings there are no minutes being
posted for any meetings since 2007
Even if it's not good new. Over $22,000 and no accounting for it! COURT RULES IN FAVOR OF SUMMERS, WATSON & WESTERN CHEROKEE 3 TIMES As of this date the defendants and their associates have not surrendered Western Cherokee Property as stipulated in two court orders and supported in the Stipulation and Order. What are the fundamental differences between the thinking of the Plaintiffs Jerry Summers, John Watson and the Western Cherokee a Missouri Non-Profit and the Defendants, Unincorporated Association claim and filing with the court. A court order did state that Chief Jerry Summers and Vice Chief John Watson have been found to be the true officials of the Western Cherokee. This should clearly show the defendants and associates were wrong in their take over attempt but they continue to refuse to abide by the Court Order. By a court ordered election which the defendants controlled they are now legally in control of the Western Cherokee future. Many people believe this ordered election was due to a filing by Timothy Spencer which was a threat of upward of 100 men, women and children would die defending the property if the judge held his ruling.
